PREAMBLE

These General Conditions of Sale and Use (CGVU) are intended to define the rules applicable to any user of the site www.madura.fr (hereinafter "the Site"), by the company Madura Online (registered trademark) ( below "the product (s)").

 

BETWEEN :

MADURA Online, Simplified joint -stock company (SAS) with a capital of 400,000 euros, whose head office is located 4 rue Tronchet, 75008 Paris, registered in the RCS de Paris under number 522.420.025, taken in the person of its legal representative domiciled in this Quality Audit seat.

 

AND :

Any user of the site.

In the context of these CGVUs, the customer is understood as any adult natural person, not trading, having the legal capacity to contract as well as any emancipated minor, having the legal capacity to contract carrying out a product purchase on the site (hereinafter " the customer "). The Customer declares that they are domiciled in a country for which delivery is offered by the site.

For the application of these presents, the user (customer or not) and the company Madura Online will be together called the "parties", individually the "part".

These general conditions of sale and use (hereinafter the "CGVU") govern without restriction any use of the Site and any purchase of products made on the Site.

 

ARTICLE 1: OBJECT

These general conditions of sale and use are intended to define the conditions under which the products are marketed by the company Madura Online to the customer. They thus govern the different stages of the sale: from placing the order to delivery of the product.

MADURA Online reserves the right to modify these general conditions of sale and use at any time. The applicable general conditions of sale and use are those in force on the site on the date of order by the Customer; it being specified that any order of a product offered on the site implies the full membership of the customer under the general conditions of sale and use in force when placing their order.

These conditions are Only valid for people who bought a product on the Madura.com site

 

Article 2. Products

The products offered for sale are those appearing on the site on the day of its consultation by the customer (hereinafter "the product" in the singular, "the products", in the plural). Each product will be subject to a descriptive sheet which, in addition to photography, will contain:

- the price,
- the sizes and colors available,
- the composition, as well as the particular characteristics.
Minimal differences between a product and its photograph may exist, depending in particular of the resolution and definition of the colors of the user screen.

MADURA Online does not make the products offered on its site.

MADURA Online undertakes to deliver products that meet the prescriptions in force relating to the safety and health of persons in accordance with European provisions.

 

Article 3. Price

The prices are indicated in euros all taxes included, excluding delivery costs; it being specified that the value added tax is that in force on the French metropolitan territory at the time of the validation of the order.

The prices applied are those communicated on the site and confirmed to the Customer when validating the order.

The delivery costs are communicated to the customer on the summary of the order before the validation of the latter and are expressed all taxes included. These costs are the responsibility of the customer and are invoiced in addition to the sale price of the products.

The transfer of the risks of loss and deterioration of the products will be carried out after delivery and reception of the products by the customer.

MADURA Online reserves the right to modify its prices at any time, but undertakes to apply the prices indicated on the site when placing the order by the Customer. Article 4. Special offers

Delivery - Prices:

The prices of the products displayed on the site are excluding shipping costs and excluding customs costs. These costs may vary depending on the product (s) present in the basket, the delivery location as well as the delivery method chosen. Returns offered for any order (excluding furniture and bulky items).

 

Premium delivery:

Premium delivery (excluding small furniture and low tables) is available for the delivery of certain products, namely large furniture (sofas, armchairs, large format poufs). Premium delivery consists of a turnkey delivery, instead of delivery set by the customer (provided that Madura Online makes deliveries on the territory concerned), in the part of your choice. For your safety as well as that of the delivery man: we thank you for ventilating the delivery part before the delivery man arrives, applying barriers (02 meters distancing) and facilitating access to the delivery part. The delivery man will take care of the information concerning delivery directly on his PDA to avoid any contact. Delivers are trained in barriers and have hydroalcoholic masks and gel in order to guarantee your safety.

Mobilier pre-order:

Some products are available in pre-order. The use of the pre-order implies the full payment of the price of the product at the time of the online pre-order. The delivery date of the pre -ordered product is mentioned as an indicative basis, certain products being manufactured "on order", the delivery times may be lengthened (in particular in the event of difficulties in supplying raw materials, of the city and/ or of the country in which one or more suppliers (s) is located, the extension of the delivery times of supplier (s), strikes, war (s), difficulty of delivery, extension of deadlines, etc. ). Article 5. Order and payment of products

5.1 Ordering

The customer materializes his order by carrying out the following five (05) steps:

Step 1: Selection of the product (s).

The customer selects the product (s) and adds them to his basket after selecting the desired size and color. The basket located at the top right of the screen informs the customer that he took into account the selections indicating the number of products it contains.

Step 2: Verification of the content of your basket.

The customer checks the content of his basket by clicking on "order" in order to have access to the summary of his order. The customer can then modify his order (product, size, quantity). The customer can then retract and delete their order. The total amount of the order, distinguishing on the one hand the price due for the product (s) (s), and on the other hand the delivery costs and any customs costs, is then indicated in the summary.

Step 3: Validation of your basket.

Step 4: Entry by the customer of delivery and invoicing contact details.

Step 5: Entering banking contact details.

The customer will then access the secure payment screen as specified in article 4.3 below. Payment is made online by bank card or via Paypal and American Express (Amex).

5.3 - Payment

The price of the products purchased is payable cash, in full on the day of the order by the customer. Payment is made online by bank card (credit card, visa, Eurocard/ Mastercard/ American Express) or via Paypal and Amex, at the time of the validation of the order by the Customer.

The request for authorization for the collection of the card is made at the time of the validation of the order on the site, except in the event of unavailability of the servers. The company MADURA Online reserves the right to make a new request for direct debit in the event that the first has not been able to lead due to the unavailability of the servers.

In the event of a payment defect, an erroneous address or any other problem on the Customer's account, the company MADURA Online reserves the right to block the customer's order until the problem is resolved.

Payment by credit card :

The transactions carried out on the site are secured by the partner's payment system, the company Hipay, SAS, simplified joint-stock company with a capital of 6,595,689 euros whose registered office is located 94 rue de Villiers, 92300 Levallois-Perret and registered at the Nanterre RCS n ° 390.334.225.

All the information exchanged to process payment is encrypted thanks to the SSL (Secure Socket Layer) protocol. These data cannot be detected, intercepted, or used by third parties. At no time do the customer's financial data transit on the computer system of the company Madura onine.

MADURA Online checks that the connection with the customer's browser is secure before sending the payment form to the banking institution which performs the financial transaction.

The company Hipay being a technical service provider, it does not take care of the disputes related to orders which are processed directly by the company Madura Online as specified before or if necessary by the customer's bank.

Fight against bank card fraud Information related to the order is subject to automated processing. The purpose of this automated processing of data is to define a level of analysis of a transaction and to combat bank card fraud.

MADURA Online is the recipient of data related to any order. The non-transmission of data related to an order prevents the realization and analysis of the transaction.

The occurrence of an unpaid one on the grounds of fraudulent use of a bank card will result in the registration of contact details in relation to the order associated with this unpaid within a "payment incident" file. An irregular declaration or an anomaly may also be subject to a specific treatment and/or measurement.

Payment in several times with Alma:
Payment in several times/delayed is available via our partner Alma. Securing payments is provided by Alma and its providers. All payments are protected by 3D Secure.

Purchasing amount
P3X: Only purchases between € 100 and € 3,000 are eligible for payment with Alma.

P4X: Only purchases between € 100 and € 3,000 are eligible for payment with Alma.

Costs
By paying in several times with Alma the customer does not pay any fees.

Alma is a tele-payment manager and issues an electronic certificate that will be proof of the amount and date of the transaction in accordance with the provisions of articles 1316 and following of the Civil Code.

Termination
Any termination of the GTC which links the seller and the customer, leads to the termination of the CGU ENTA Alma and the customer.

 

5.4 - Archiving of the order

The order confirmation is recorded in the registers of the company Madura Online, themselves kept on a reliable and durable support. The Customer accepts that the order confirmation is considered as proof of the contractual relations between the parties.

 

Article 6. Delivery

6.1. Delivery territories

MADURA Online provides the delivery of all of its products to metropolitan France (including Corsica), Belgium, Luxembourg.

It also provides delivery of its products (excluding furniture and bulky products) to Spain, Italy, Austria, Ireland, Portugal, Germany, Switzerland, the Netherlands, the Czech Republic, Denmark, Estonia, Hungary, Latvia, Lithuania, Poland, Slovakia, Slovenia, Sweden, Bulgaria, Croatia, Cyprus, Finland, Greece, Malta, Romania, 'Iceland, Norway and the United Kingdom. Also, Guadeloupe, Reunion, Mayotte, Martinique, Saint-Barthélemy, Saint-Martin, Saint-Pierre-et-Miquelon, French Guyana, French Polynesia, New Caledonia, Wallis-et-Futuna, Les Terres françaises .

Possible customs costs are the responsibility of the customer.

6.2. Delivery delay

Madura Online will deliver orders with a delivery note within a maximum period of ten (10) working days for delivery to mainland France, and twelve (12) working days for delivery to other destinations , and this from the day following the payment of the order.

Any order recorded on the site from Monday to Thursday before 11 am will be processed the same day. If the order has placed after 11 hours, it will be processed the next day. Any order placed on Friday after 3 p.m., Saturday and Sunday will be treated the following Monday; it being specified that the orders placed one public holiday will be processed the next working day.

ATTENTION, deadlines can be exceptionally elongated during periods of strong activities (sales, Madura Days, Black Friday etc.), as well as during school holidays.

Deadlines for furniture: for large furniture (sofas, armchairs, marble table), delivery times are provided for information and can be extended. Customer service will contact the Customer once the order is formalized to provide more information.

In the event of exceeding the delivery time, not justified by a case of force majeure (war, economic, social, sanitary crisis, insurrection, administrative decision, etc. Non -limitation list), the Customer may request the resolution of the sale and obtain in A maximum period of 30 (thirty) days the reimbursement of the sums paid during the sale. As part of a delivery made via Colis Relais, this period is extended to 40 (forty) days.

6.3. Recovery of the old furniture.

From 01/01/2022, Madura Online undertakes to resume your old furniture for free (sofa, armchair, table, poufs, headboard) for any purchase of a new Madura product similar to that recovered (nature and dimensions ). To do this, the request must be sent to our Customer Service through our contact form or to the address eshop@madura.fr. The product taken up by us must be of the same nature and the same dimensions as the Madura new product ordered.

Recovery takes place at the time of delivery of the new furniture and applies to the same conditions as the delivery method chosen:

- If the order has been placed with the premium delivery method in the room of your choice, then the furniture to be taken up by the delivery people must be located in the same place as the place intended for delivery.
- No recovery is made on home delivery methods such as Colissimo and Chronopost, any more than in relay.

Recovery can also be done in a physical way, by appointment, only in our stores with an area greater than 200m². No fees will be applied to recovery if all the conditions stipulated are applied.

6.4. Eco-mobilier.

Madura is recorded in the national directors' register on the furniture elements market under the number FR023375_10R40F. This number guarantees the fact that Madura joining Eco-Mobilier, and is in accordance with the regulatory obligations incumbent upon him in application of the provisions of article L541-10-6 of the environment code.

 

Article 7. e-reservation

7.1. E-reservation methods

The reservation is made in several stages:

In accordance with the regulations, the company MADURA Online will make the archiving of booking requests on a reliable medium. In all cases, the customer is recommended to keep the email and/or the validation SMS of their reservation.

7.2. Boutiques affected by e-reservation

Products can only be reserved in stores the company Madura Online located in mainland France and presented in the list of the e-reservation service. The opening hours can be viewed for information only on the site. The selected store undertakes, from the customer's booking request made on the Site, to take into account their request within the period indicated during the reservation process and according to the opening hours and days of the store (outside period of sales and non -working holidays and not worked, excluding Sunday).

This taking into account will be the subject of the sending of an email and/or SMS of partial or total confirmation of the reservation by the store according to the availability of the products. The response time for the required booking request is given as a strictly indicative basis and cannot force the company Madura Online.

The customer is aware that this period may notably not be respected in the event of difficulty relating to his reservation, preventing the taking into account of the latter by the store.

7.3. Withdrawal of e-reserved products

Upon receipt of the email or the confirmation SMS sent by the store, the products will be reserved during the reservation period which is mentioned in the SMS and/or the confirmation e-mail in the store selected by the Customer. The date and time limit for the withdrawal of the reservation will also be specified in this email and/or this SMS. The Customer can then withdraw the products, in the store selected when booking on the site and in the opening hours of this store. In order to be able to withdraw their products, the customer must at least justify his name & first name, or his e-mail / SMS of reservation confirmation.

7.4. Availability of e-reserved products

Product and price offers are valid as long as they are visible on the site www.madura.com, except special operations whose validity duration is specified on the site. The customer is invited to check the availability of the items sold on the information page of each product. The availability in stock of products reports stocks in the store selected by the customer, at the time of the last update of this state. The stock of products is not updated in real time on the site, but only twice a day, so that there can be a gap when placing an order. Also, the availability of products can only be given as an indication, the products that can be sold between the time of booking by the customer and the validation of this reservation by the store. In the event of a reservation of several products, if one of the products is unavailable, the store will reservation of all the available products. 7.5. Payment of e-reserved products

Reservation of the product in the store selected by the Customer does not involve the customer's online payment. Payment is made in the store, when the goods withdrawn, by any means of payment in force at the store and according to the general conditions of sale of shops.

  

Article 8: Reception of the order - Complaints - Returns

The customer is required to check the compliance of all the products received in execution of his order at the time of delivery. Any anomaly concerning delivery such as:

- damaged package,
- missing products,
- deteriorated products,
- Products not in accordance with the order,
must be notified within the legal deadlines depending on the reception of the order.

This notification will be sent to the customer service of the company Madura Online is:

After these legal deadlines, and except hidden defect, no complaint will be accepted, the products being then deemed in accordance.

For any non-conforming product return, the customer must comply with the following procedure:

A- The Customer must attach to his package the return voucher previously completed and printed using the return form accessible from the customer area - "My orders" section. No return can be accepted without the duly completed return voucher.
B- The products must be returned either to their original packaging, or in a packaging protecting the product against any deterioration, with their label and their possible accessories allowing their new marketing, at the following address:

After this period, and except hidden defect, no complaint will be accepted, the products being deemed in accordance with compliant.

When non-compliance has been noted, it will be offered to the Customer:

• replacement of the product (s) payable by the seller, either
• Refund of the order price (price of products and delivery costs) as well as the return costs of the non-conform product, at the latest in the fourteen (14) days from the date of sending the notification confirmation of non-compliance by customer service on the site Madura Online.

In the event of reimbursement, the customer will be reimbursed for all the products rendered in accordance with. The return in counter-reimbursement are not accepted. Article 9. Right of withdrawal

• For any purchase made on the Internet, no return can be made in Madura stores.

o The shipping costs are reimbursed if the order has returned in its entirety.
o The items must be returned to their original packaging, with their label and any accessories, in a perfect state of resale. They should therefore neither have been worn, retouched, washed, nor damaged.

• The reimbursement is made within a maximum period of fourteen (14) working days after receiving the return by bank credit or recreditation of the PayPal account.

If these conditions are not met, the site www.madura.com reserves the right not to accept the return. These conditions are only valid for people who bought on the Madura.com site. For any purchase made in Madura shops or on approved resellers, only the general conditions of these shops apply.

MADURA Online will not be responsible for the total or partial non-execution of its obligations under the order placed by the Customer, if this non-execution is caused by an event constituting a case of force majeure as defined by positive law.

In such a case, the company Madura Online will inform the customer of the occurrence of such an event as soon as possible, and when possible within three (03) free days following its occurrence, by email.

After a period of one (01) month, and in the event that the constitutive event of a case of force majeure persists, the order will be canceled and will, if necessary, the subject of a refund of the company Madura Online on the bank card used to place the order within a maximum period of 30 (thirty) days.

 

Article 15. Non renunciation

The fact of not claiming at some point in any of these provisions of the General Conditions of Sale and Use, cannot be interpreted as a waiver of Madura Online to take advantage of any of the said conditions later .

 

Article 16. Applicable law / dispute

If any of the terms of these General Conditions of Sale and Use were struck by nullity, illegality or unenforceability by court decision, the other provisions would remain in force.

The general conditions of sale and use are executed and interpreted in accordance with French law. Without achieving an agreement, the customer can, if he wishes, ask to have recourse to mediation.

MADURA Online is registered with the Center for Mediation for the Consumption of Justice conciliators (CM2C)-14 rue Saint-Jean-75017 Paris mediator of consumption.

In the event of disputes, the customer was addressed by priority to the company Madura Online to obtain an amicable solution and in the absence of an understanding, the courts of ordinary law will be sole competent, in the jurisdiction of the Paris Court of Appeal (France ).
